Your Legal Rights and Remedies
Excessive noise from your upstairs neighbour disrupting your life? Here’s how to address condo noise complaints effectively.
Noise nuisance is one of the most frequent complaints in condo living and strata properties across British Columbia. Whether it’s loud music, heavy footsteps, or constant disturbances from an upstairs unit or neighbouring unit, understanding your rights under strata bylaws is crucial.
Step 1: Report to Your Property Manager
The first step in addressing excessive noise complaints is to contact your property manager. Document the dates, times, and nature of the disturbances. The property manager will investigate the noise violation and report findings to the strata management company and strata council.
Step 2: Strata Council Action
If the noise is truly excessive and violates strata noise bylaws, the strata council will typically take action. The severity of response often depends on the time of day and frequency:
- First offense: Written warning to the offending unit owner
- Continued violations: Strata fines as permitted under the Strata Property Act
- Persistent issues: Escalating fines and potential legal action
Strata corporations have the authority to enforce noise bylaws and issue penalties for bylaw violations.
Step 3: Legal Action Through CRT
If the noise nuisance continues despite strata enforcement, you can seek legal remedies through the Civil Resolution Tribunal (CRT). The CRT BC handles strata disputes and can issue:
- Orders requiring compliance with strata bylaws to stop the excessive noise
- Orders for bylaw enforcement
- Monetary compensation for damages in some cases
The CRT provides an affordable alternative to BC Supreme Court for resolving condo disputes and strata property disputes. CRT decisions can be enforced like court orders.
For traditional injunctions (mandatory or prohibitive), BC Supreme Court would be required, though the CRT’s compliance orders often achieve similar results at lower cost.
Document Everything
For successful noise complaint resolution, maintain detailed records including dates, times, duration, and the type of noise. Video or audio recordings can support your case in CRT proceedings.
