Tree disputes between neighbours are among the most common property boundary conflicts in British Columbia. Recently, I represented a client in BC Supreme Court against their neighbour for tree nuisance causing significant property damage to their roof.

The Problem: Overhanging Trees and Boundary Issues

The neighbour’s property had several tall trees growing along the property boundary line. The overhanging tree branches, accumulating leaves, and falling dead branches created an ongoing nuisance that resulted in costly roof damage and maintenance issues.

Despite multiple attempts at neighbour dispute resolution, the tree owner refused to trim overhanging branches or maintain their trees properly. This left our client with no choice but to pursue legal action.

Legal Remedies: Injunctions and Damages in BC

We are now seeking both mandatory injunction and prohibitive injunction orders in BC Supreme Court, along with compensation for damages.

A mandatory injunction would require the neighbour to trim the trees and remove hazardous branches. A prohibitive injunction would prevent future encroachment and require ongoing maintenance. Additionally, we’re claiming damages for property damage caused by the tree encroachment.

Your Rights Under BC Property Law

Under British Columbia property law, property owners have certain rights regarding overhanging trees and encroaching vegetation:

  • You can trim branches that cross your property line (at your own expense)
  • If tree roots or branches cause damage, the tree owner may be liable
  • Tree nuisance claims can include damage to structures, blocked sunlight, and ongoing maintenance costs
  • Courts can order neighbours to maintain their trees properly
